Significant Update in the Labor Code: Narcological Examination Requirement for Accountants and Cashiers
New steps are being taken in the labor legislation of the Republic of Azerbaijan that will fundamentally change the personnel accounting and recruitment process. Within the framework of four new bills submitted to the Milli Majlis, significant additions are planned for Article 48 of the Labor Code.
This change brings to the forefront the submission of a mandatory narcological examination report, especially during the recruitment of individuals working in financial, cash, and materially responsible positions.

What Innovations are Expected in the Legislation?
According to the proposed changes, two new clauses are added to Article 48 of the Labor Code (Documents submitted by the employee when concluding an employment contract):
  • Clause 5-2: During recruitment for professions and positions with activity restrictions for narcological patients, employees must submit a report on a medical examination (check-up) issued by a state narcological medical institution.
  • Clause 5-3: Hiring an employee for the relevant profession and position without the mentioned medical report is strictly prohibited.
Which Positions are Included in This List?
According to the "List of types of professions and positions with activity restrictions for narcological patients" approved by decision No. 145 of the Cabinet of Ministers, the following persons will have to submit a certificate during recruitment:
  • Accounting: Accountants and chief accountants directly involved in cash transactions.
  • Treasury: All treasury managers and cashiers working in enterprises and banks.
  • Control and Inspection: Materially responsible persons, supervisors, and those performing internal audit functions.
  • Banking Sector: Other specialists who carry out cash transactions and are in contact with cash.
Strategic Steps for Employers
This change is not only a legal requirement but also a guarantee for the internal security of the enterprise. HR professionals and company managers should consider the following points:
  • Updating the Recruitment Package: "Narcological certificate" must be added to the list of documents required from candidates.
  • Analysis of Job Descriptions: It must be precisely determined which positions fall under the framework of "cash transactions" and "material responsibility".
  • Legal Responsibility: Appointing an employee to these positions without a certificate can lead to severe fines by the labor inspectorate in the future.
